The terms and conditions governing the fire safety and protection services provided by DCC Fire Alarm Services Pty Ltd.
Last updated: 1 July 2025
1. About These Terms
These Terms of Service (“Terms”) apply to all fire safety and protection services supplied by DCC Fire Alarm Services Pty Ltd (ABN 94 163 036 593), trading as DCC Fire Alarm Services, of Melbourne VIC (“we”, “us”, “our”). By requesting a quote, engaging our services, or accepting a written service agreement, you agree to be bound by these Terms. These Terms apply in addition to, and should be read together with, any signed quotation, work order or service agreement between you and us.
2. Australian Consumer Law
Our services come with guarantees that cannot be excluded under the Australian Consumer Law set out in Schedule 2 of the Competition and Consumer Act 2010 (Cth). Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy conferred by the Australian Consumer Law or any other applicable law. Where the Australian Consumer Law applies and cannot be excluded, our liability for a failure to comply with a consumer guarantee is limited, to the extent permitted by law, to the supply of the services again or the payment of the cost of having the services supplied again.
3. Quotes and Engagements
- Quotes provided by us are valid for 30 days from the date of issue unless otherwise stated in writing.
- A quote is an estimate based on the information you provide and a site assessment where required. Final pricing may vary if the actual scope of work differs from what was quoted.
- A engagement is confirmed only when you accept a quote in writing (including by email) or we issue a written service agreement, and any required deposit has been received.
- Any variation to the agreed scope of work must be agreed in writing before it is carried out, and may result in additional charges.
4. Payment Terms
- Invoices are payable within 14 days of the invoice date unless otherwise agreed in writing.
- We may require a deposit before commencing certain work, including parts supply and installation projects.
- Overdue invoices may attract interest and reasonable recovery costs. We may suspend services or withhold essential safety documentation until overdue amounts are paid.
- All prices are in Australian dollars and include GST unless stated otherwise.
5. Access to Premises
You are responsible for providing safe and timely access to your premises, equipment, plant rooms, and any required authority approvals (such as body corporate or landlord consent) during agreed appointment times. If we are unable to access the premises at an agreed time, a call-out fee may apply.
6. Your Responsibilities
You must ensure that your premises and fire safety systems are used in accordance with relevant standards, and that you disclose any known hazards, faults or prior defects to us before we commence work. You remain responsible for routine occupant obligations such as keeping exits clear and responding to alarm events.
7. Compliance and Standards
Our work is performed in accordance with Australian Standards, including AS 1851 for routine service of fire protection systems and equipment, AS 1670 for fire detection and alarm systems, the National Construction Code, and applicable Victorian building and fire safety legislation. Where existing systems or buildings do not meet current standards, we will advise you, but rectification of pre-existing non-compliance may be quoted separately.
8. Documentation and Essential Safety Measures
Where we perform annual essential safety measures assessments or routine servicing, we will provide you with reports and records consistent with our scope of engagement. You are responsible for retaining these records and for any annual essential safety measures reporting obligations to your municipal council.
9. Limitation of Liability
To the extent permitted by law, and subject to the Australian Consumer Law and any non-excludable guarantees:
- We are not liable for any indirect, consequential, or economic loss, including loss of profits, business interruption, or loss of data arising from our services.
- We are not liable for defects, faults, or failures in pre-existing systems, equipment or installations that were not supplied or installed by us.
- Our total liability for any claim arising from our services is limited to the amount you paid us for the services giving rise to the claim.
Nothing in this clause limits our liability for death or personal injury caused by our negligence, or for any other liability that cannot lawfully be excluded.
10. Warranty on Workmanship
We warrant our workmanship for 12 months from the date of completion. This warranty does not cover defects caused by misuse, unauthorised modification, third-party interference, or normal wear and tear. Manufacturer warranties apply to equipment and parts we supply.
11. Cancellation and Rescheduling
Appointments may be rescheduled or cancelled with at least 24 hours’ notice. Cancellations with less than 24 hours’ notice, or failure to provide access at an agreed time, may attract a reasonable cancellation fee.
12. Intellectual Property
All reports, plans, documentation, and other materials we produce remain our intellectual property unless expressly assigned in writing. You are granted a licence to use these materials for the purpose of managing your fire safety obligations.
13. Privacy
We collect and handle personal information in accordance with our Privacy Policy, which forms part of these Terms.
14. Dispute Resolution
If you have a concern about our services, please contact us first so we can resolve it promptly. If a dispute cannot be resolved by direct discussion, both parties agree to attempt good-faith mediation before commencing legal proceedings, except where urgent injunctive relief is required.
15. Governing Law
These Terms are governed by the laws of Victoria, Australia. The parties submit to the jurisdiction of the courts of Victoria and the Commonwealth of Australia.
